Terms of Use

This is an English translation provided for convenience. The Croatian version is the authoritative text and prevails in the event of any discrepancy.

1. Introductory provisions

These Terms of Use (the "Terms") govern the relationship between you (the user) and the trader:

(the "Service Provider" or "we")

in connection with the use of the BajsRoute mobile application (the "App") and the associated website (the "Website"). The App and the Website together are referred to as the "Service".

By using the Service you confirm that you have read, understood and accepted these Terms. If you do not agree with these Terms, please stop using the Service.

2. Description of the service

BajsRoute is a free mobile app for cycling navigation across the City of Zagreb. The Service comprises:

• a map of the City of Zagreb's cycling infrastructure based on open data,
• cycling route calculation and navigation,
• display of Bajs public bike-share stations and public bicycle parking,
• the ability to rate sections of bike paths,
• the ability to report infrastructure problems on sections of paths,
• a website with information about the App.

The Service is free of charge. The Service Provider reserves the right to change, extend or discontinue individual features of the Service from time to time without prior notice.

3. Access conditions and user account

3.1. Browsing without registration

The map of cycling infrastructure, the display of ratings and the navigation are available without registration or sign-in.

3.2. Registration

To use the rating and problem-reporting features you must sign in with a Google account (Google Sign-In). By signing in you accept these Terms and the Privacy Policy.

3.3. Age limit

The Service is intended for people over 16. By using the Service you confirm that you are at least 16 years old. If we learn that a user is under 16, we reserve the right to close the user account and delete the associated data.

3.4. Responsibility for the account

You are responsible for the security of the Google account you use to access the Service. The Service Provider is not liable for unauthorised access to the Service resulting from a compromise of your Google account.

4. Rules of use

By using the Service you undertake to:

• use the Service solely for its intended purpose and in accordance with these Terms,
• submit only content that is truthful, accurate and related to cycling infrastructure,
• not use the Service to distribute unlawful, offensive, threatening or discriminatory content,
• not attempt to disrupt the operation of the Service, access other users' data or circumvent the system's security measures,
• not use automated tools (bots, scripts, scrapers) to access the Service without the Service Provider's prior written approval.

The Service Provider reserves the right to remove content that breaches these rules, to suspend or permanently disable access to a user account, and to take other reasonable measures to protect the Service and its other users.

5. User-generated content (UGC)

5.1. Content you submit

Through the Service you may submit ratings of bike path sections and reports of infrastructure problems (including text comments and location data). That content (the "User Content") remains yours in terms of copyright, where applicable.

5.2. The licence you grant us

By submitting User Content you grant the Service Provider a non-exclusive, royalty-free, perpetual, irrevocable and transferable licence to use, store, display, aggregate and share that content within the Service, including:

• showing ratings in aggregated form (the average rating of a section) to all users of the App,
• showing individual ratings, the comments attached to them and problem reports to all users of the App on the section they belong to, together with the nickname you chose in your profile,
• showing problem reports, including any attached photo, to authorised administrators through the internal admin panel,
• using aggregated data in reports on the state of the cycling infrastructure.

This licence does not include any right for the Service Provider to sell your User Content to third parties.

5.3. Responsibility for content

You are responsible for the content you submit. The Service Provider accepts no responsibility for the accuracy, completeness or lawfulness of User Content. The Service Provider reserves the right to remove or edit User Content that breaches these Terms or applicable regulations.

6. Limitation of liability and disclaimer

6.1. Information purposes only

Route data, section ratings and the map of cycling infrastructure are provided for information purposes only. The App is not a substitute for your own assessment of conditions on the road. You must observe the traffic regulations of the Republic of Croatia and ride carefully at all times, regardless of the information shown in the App.

6.2. Accuracy of data

The Service Provider makes reasonable efforts to ensure the accuracy of the data shown, but does not warrant that data on bike paths, routes, public bike-share stations or parking is complete, up to date or accurate at any given moment. Infrastructure data is based on the City of Zagreb's open data, published by third parties and subject to change without notice.

6.3. Limitation of liability

To the fullest extent permitted by applicable law, the Service Provider is not liable for:

• any direct, indirect, incidental, consequential or special damage arising from the use of, or inability to use, the Service,
• damage arising from reliance on information shown in the App (routes, ratings, map data),
• loss of data, interruption of access to the Service, or device failure in connection with use of the App,
• acts or omissions of third parties whose services the App uses (Google, GraphHopper, OpenStreetMap).

This limitation does not affect consumer rights that cannot be excluded under the mandatory regulations of the Republic of Croatia, including the provisions of the Consumer Protection Act (Official Gazette 19/22) and the Civil Obligations Act (Official Gazette 35/05, as amended).

7. Intellectual property

7.1. The Service Provider's property

The App, the Website, their source code, design, logo and other related materials are protected by copyright and other intellectual property rights. All rights are reserved to the Service Provider, except for the rights expressly set out in these Terms.

7.2. Open data and open-source software

The App uses the City of Zagreb's open data (ZG Geoportal, Bajs stations, public bicycle parking) and open-source components (Leaflet, GraphHopper, Nominatim). The licences for those components are listed on the Licences page.

8. Availability of the service

The Service is provided "as is" and "as available". The Service Provider does not warrant uninterrupted, timely or secure access to the Service. Occasional interruptions may occur due to system maintenance, technical difficulties or circumstances beyond our control.

The Service Provider reserves the right to suspend or permanently discontinue the Service without prior notice and without liability to users.

9. Termination

9.1. Your right to stop using the Service

You may stop using the Service at any time by uninstalling the App. To delete your user account and the associated data, send a request to binspired.obrt@gmail.com.

9.2. Our right to terminate

The Service Provider may disable your access to the Service or delete your user account if:

• you breach these Terms,
• you use the Service in a way that harms other users or the operation of the system,
• this is necessary for security or legal reasons.

10. Changes to the Terms

We may amend these Terms from time to time. We will notify you of significant changes through a notice in the App or on the Website. By continuing to use the Service after the changes are published, you will be deemed to have accepted the amended Terms. If you do not agree with the amended Terms, you must stop using the Service.

11. Governing law and dispute resolution

These Terms are governed by the law of the Republic of Croatia.

For any disputes arising out of or in connection with these Terms, the parties will seek to resolve the dispute amicably. If an amicable resolution is not possible, disputes fall under the jurisdiction of the subject-matter and territorially competent court in Rijeka, Republic of Croatia.

If the user is a consumer within the meaning of the Consumer Protection Act, jurisdiction is determined in accordance with the regulations governing jurisdiction in consumer disputes, including the option of using the European Commission's Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr/
